Online Terms of Use 

1.    Minimum Age  

You must be aged 18 or over to use this Web Site or book tickets online.  Our competitions and promotions are for adults aged 18 or over.   

2. Use of our Web Site 

 2.1.    The following terms (the "Terms") apply when you visit or use the MCRPALFF website ("Web Site"), so please read them carefully. 

 2.2.    In these Terms, “MCRPALFF” means MCR Palestine Film Festival CIC, a community interest company registered in England and Wales under company number 15612921 with registered address at Unit 8 Cunningham Court, Lions Drive, BB1 2QX. 

 2.3.    By accessing or using the Web Site, you accept and agree to be legally bound by these Terms and acknowledge that MCRPALFF has the right to amend or vary these Terms and any of the contents of the Web Site from time to time at its sole discretion.  Amendments or variations will take effect when they are posted on the Web Site, so you should check the current version of the Terms each time you use the Web Site.  These Terms, as amended or varied from time to time, apply to all use of, access to and downloads from the Web Site, both now and in the future. 

 2.4.    Additional terms and conditions may apply for any purchases made through the Web Site.  If so, you will be prompted to view such additional terms and conditions on our Web Site at the time of making such purchases and those terms and conditions will apply in addition to these Terms to the extent that the context permits. 

3. General Disclaimer 

 3.1.    Although MCRPALFF has attempted to provide accurate information on the Web Site, MCRPALFF assumes no responsibility for the accuracy or completeness of such information.  Except as stated elsewhere in these Terms you release MCRPALFF from any liability, for any claims, losses or damages arising out of or in any way connected with your use of the Web Site.   

 3.2.    To the fullest extent permitted by law and except as stated elsewhere in these Terms, MCRPALFF shall not be liable to any person or entity for any direct, indirect, special, consequential or incidental damages, including (without limitation) lost profits or revenues, loss of opportunity, costs of replacement goods or services, loss or damage to data or business interruption, arising out of or related to: 

3.2.1.    any access to or use of or inability to access or use the Web Site, any other hyperlinked web site or any other information or product included or described within the Web Site; or 

3.2.2.    your or any other person or entity's reliance on the information presented, 

3.2.3.    in each case whether arising in tort (including negligence), contract or otherwise even if you have advised MCRPALFF of the possibility of such damages. 

 3.3.    All information and content provided on the Web Site is provided "as is" without representation or warranty of any kind, either expressed or implied. Without limiting the foregoing, MCRPALFF does not represent or warrant that the Web Site or any of its contents are accurate, current, complete, free from technical or typographical errors, free from changes or harmful components introduced by third parties or free from periodic interruption or errors of any other type.  MCRPALFF may revise the information or change the products or services mentioned on the Web Site at any time without notice. Any mention of non-MCRPALFF products or services is for information purposes only and constitutes neither an endorsement nor a recommendation of them. Neither MCRPALFF, nor their suppliers, make any representation or gives any warranty, condition or undertaking, expressed or implied, including (without limitation) as to the satisfactory quality, fitness for a particular purpose, suitability or non-infringement of any third party right or freedom from viruses, whether or not arising from a course of dealing, usage or trade practice. 

 3.4.    Nothing within these Terms limits or restricts any person's liability for death or personal injury resulting from its negligence or that of its employees or agents. 

 3.5.    These Terms and any disputes or claims arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales and you can bring proceedings in the English Courts.  

 3.6.    MCRPALFF makes no representation that the content or materials on the Web Site are appropriate or available for use in other jurisdictions. Access to the Web Site's content or its materials from jurisdictions where such access is illegal is prohibited.  If you choose to access the Web Site from other jurisdictions you do so at your own initiative and risk and are responsible for compliance with all relevant local laws.  MCRPALFF is not responsible for any violations of law as a result of your actions. 

4. Trademarks and other such rights

4.1.    The trade marks and logos ("Marks") displayed on the Web Site are the property of MCRPALFF or other third parties.  You are not permitted to use these Marks without the prior written consent of MCRPALL or the relevant third party proprietor of the Marks, and you acknowledge that any such use may constitute an infringement of the relevant proprietor's rights. 

4.2.    You acknowledge that all intellectual property rights in all materials on the Web Site remain the property of MCRPALFF or the relevant third party proprietor, licensor or other content owner.  Except as expressly permitted herein, no portion of the information on the Web Site may be reproduced in any form, or by any means, without prior written permission from the Mark owner. 

 4.3.    You must not use any part of the content on the Web Site for commercial purposes without obtaining a licence to do so from us or our licensors. 

 5. Links to third party web sites 

 5.1.    The Web Site contains links to third party web sites.  Access to any other web site through a link on the Web Site is at your own risk and MCRPALFF is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on these sites or the security of any link or communication with those sites. 

 5.2.    MCRPALFF reserves the right to terminate a link to a third party site at any time. 

 5.3.    The provision of advertisements for third party goods or services or a link to a third party web site through the Web Site does not mean that MCRPALFF endorses, authorises or sponsors those products and services or that web site nor does it mean that MCRPALFF is affiliated with the third party web site's owners or sponsors. MCRPALFF provides these links merely as a convenience for you and other visitors to our Web Site. 

6. Web site security 

6.1.    You agree not to corrupt (or attempt to corrupt) any data or to circumvent (or attempt to circumvent) any of the security safeguards of MCRPALFF or any of its suppliers. 

6.2.    You acknowledge that the Internet is not entirely secure and whilst MCRPALFF and our payment providers take all reasonable steps to safeguard the security of any payment information you provide through encryption methods, MCRPALFF shall not be liable for any damage that you may suffer as a result of the loss of confidentiality of any such information. 

7. Online ticket purchases and fees 

7.1.    The following terms apply when you purchase tickets through the Web Site.   

7.2.    Use of tickets purchased online will be subject to the terms and conditions set out in Section 8. It is important you read Section 8 before booking tickets as refunds will not be given where you or a member of your party are refused entry to the cinema for non-compliance with those terms.  Please note:  

7.2.1.    Arriving later than the advertised performance time or start of the feature presentation may mean admission is refused;  

7.2.2.    entry to a film may be refused if the customer is under the minimum age required by the British Board of Film Classification for a screening and cannot prove to a MCRPALFF representative at the venue that they are at least the minimum age required.   

7.3.    By requesting tickets through the Web Site, you are placing a booking request for tickets on the Terms that is only deemed accepted by and binding on MCRPALFF once valid payment has been processed and you have been sent an email confirmation of your booking.  

7.4.    Tickets are sold at the prices stated on the Web Site at the time of purchase. Please note that prices for tickets may vary depending on the film and may change between the date of purchase and the date of the relevant performance. Where the price paid for the tickets differs to the price for equivalent tickets available for purchase at the time and date of the performance, MCRPALFF will not charge for and you may not claim any refund of the difference.  

7.5.    The email confirmation of a booking will set out the details of the cinema tickets purchased, the total amount paid, a unique order number and a QR code.  The email confirmation will include a PDF order confirmation attachment which serves as your ticket for admission purposes.  

7.6.    Tickets must be presented for checking by a member of MCRPALFF staff at the ticket check point to gain entry to the booked screening.  

7.7.    MCRPALFF will endeavour to screen films in accordance with its advertised programme. However, there will be instances when its ability to show a performance is impaired by circumstances beyond its control.  In such situations, MCRPALFF reserves the right to cancel a performance, vary the time it shows it or provide customers with an alternative performance.  If MCRPALFF does have to cancel a performance, your sole remedy shall be a refund of the admission price paid for the relevant tickets and, where appropriate, booking fees, and no other costs. 

7.18.    You may purchase cinema tickets on behalf of yourself and friends and family, but you must not re-sell those tickets or offer them for re-sale. 

8. Terms of Entry 

8.1 Behaviour: MCRPALFF reserves the right to require customers who are disruptive, antisocial or violent to leave the cinema immediately without any entitlement to a refund. What constitutes disruptive, antisocial or violent behaviour shall be determined at the sole discretion of MCRPALFF and includes both physical and verbal abuse. 

8.2 Alcohol and Food Policy: Neither alcohol nor hot food may be brought onto the premises.  Only hot food bought on the premises may be consumed on the premises.  Alcohol may only be purchased and consumed in the bar areas and licensing laws will be strictly enforced. 

8.3 Mobile Devices: All mobile devices including mobile telephones must be switched off at all times during the feature presentation. 

8.4 Piracy: Customers are not allowed to bring any form of recording or copying equipment into the auditorium. Recording or copying equipment taken into the auditorium may be confiscated for inspection by MCRPALFF staff. Customers are reminded that it is a serious criminal offence to copy or attempt to copy any film, soundtrack or other copyright protected material shown in the auditorium and customers found in contravention will be liable on conviction to an unlimited fine and imprisonment of up to 10 years. 

8.5 Certification: MCRPALFF is not responsible for the certification of adverts, trailers or films. All complaints in respect of the wrongful classification of any of these items should be directed to the British Board of Film Classification (the BBFC). 

8.6 Refunds: Tickets purchased are non-refundable. Ticket prices may change between the date of purchase and the date of the relevant performance.  Where the price paid for the tickets differs to the price for equivalent tickets available for purchase at the time and date of the performance, MCRPALFF will not charge for and customers may not claim any refund of the difference. 

8.7 Only customers in possession of a valid ticket will be admitted into the auditorium to which the ticket relates and admission will be permitted only for the duration of the performance specified by the ticket. At the time of collection, customers should check that the ticket’s details are correct as tickets cannot be later exchanged or refunded in the event of any error. 

8.8 Lost, stolen or damaged tickets will not be replaced. Any customer who does not hold a valid ticket may be required to leave the premises. 

8.9 Customers should keep their tickets/order confirmation with them at all times in order to re-enter the relevant auditorium. 

8.10 MCRPALFF will refuse admission to any person who, in the opinion of an authorised MCRPALFF representative, is under the minimum age required by the BBFC classification for a presentation and cannot prove that they are at least the minimum age required. MCRPALFF reserves the right to request photographic identification verifying the age of the customer (e.g. a driving licence or passport) for entry into 12A, 15, 15A, 16 and 18 certificated films.   

8.11 In order to avoid disturbing other customers, customers who arrive after the start of the feature presentation will only be permitted entry into the auditorium at the discretion of MCRPALFF staff or representatives. 

8.12 MCRPALFF reserves the right to refuse the entry of any person who is believed to be intoxicated and may require any person or customer who is believed to be intoxicated to leave the premises immediately without any entitlement to a refund. 

8.13 No customer is allowed to bring any illegal substances or weapons onto the premises. Anyone found in possession of such items will be refused entry or will be required to leave the premises immediately without any entitlement to a refund.  

8.14 In order to comply with applicable health and safety legislation, customers must at all times remain within the public areas of the premises and must not obstruct the aisles with personal belongings. 

8.15 Customers must keep their personal belongings with them at all times. MCRPALFF accepts no responsibility for the loss, theft, alteration or damage to any personal items brought onto the premises. 

8.16 Nothing in these terms and conditions affects your statutory rights as a customer or excludes or limits MCRPALFF’s liability for fraud or for death or personal injury resulting from MCRPALFF’s negligence or for any other liability which MCRPALFF cannot exclude or limit under law but otherwise MCRPALFF’s liability to you as a customer shall be limited to the ticket price paid. 

8.17 MCRPALFF accepts no responsibility for any information displayed or broadcast on the premises by any third party. 

9. Prices and payment 

9.1.    You acknowledge that MCRPALFF is entitled to handle any personal information that you supply when using the Web Site in accordance with the Privacy Policy, which forms part of these Terms.  

9.2.    If an online pricing error occurs, and the error could reasonably be recognised by you as an error, MCRPALFF is not obliged to supply at the incorrect price, even after the confirmation page has been displayed and confirmation email has been sent to you. 

9.3.    We accept payment by the debit and credit card. You must provide the payment card details as indicated on screen during the payment process.  Our payment service providers will use those details you provide to process the payment on our behalf. Transactions will appear on the cardholder’s bank or card statement as a payment to www.mcrpalff.org

10. Privacy 

10.1.    You acknowledge that MCRPALFF is entitled to handle any personal information that you supply when using the Web Site in accordance with the Privacy Policy, which forms part of these Terms. 

11. Questions and complaints 

11.1.    All complaints or queries in relation to any purchases made online via the Web Site should be addressed to MCRPALFF by email to contact@mcrpalff.org. 

11.2.    Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to use alternative dispute resolution.  

12. Other important information 

12.1.    The failure of MCRPALFF to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right. 

12.3.    MCRPALFF will not be in breach of these Terms or otherwise liable for any delay in performance of them to the extent that such breach or delay is due to circumstances beyond our reasonable control. 

12.4.    If any part of these Terms is unenforceable, invalid or illegal (including any provision in which MCRPALFF excludes its liability to you), the enforceability, validity or legality of any other part of these Terms will not be affected or impaired in any way. 

12.5.    Any notice to be given by either party to the other may be sent by email or recorded delivery to the address of the other.  In the case of MCRPALFF, this address shall be Unit 8 Cunningham Court, Lions Drive, BB1 2QX, or by email to contact@mcrpalff.org.  MCRPALFF will send notices to you at the address you provided at the time of registration or such other address you have since notified to us in writing or by email to contact@mcrpalff.org.  If sent by email, a notice shall be deemed to be received on the day it was sent or, if sent by recorded delivery, shall be deemed to be served two days following the date of posting.
